Who Can Issue a Doctor's Note?

Family physicians and nurse practitioners can both issue a doctor's note in most provinces. Employment standards legislation typically asks for evidence from a "qualified health practitioner" rather than naming physicians specifically, so a note from a nurse practitioner generally carries the same weight as one from a physician.

In Ontario, the Employment Standards Act lists physicians, registered nurses, and psychologists as qualified health practitioners. Other provinces and the Canada Labour Code use the broader "qualified health practitioner" language without naming roles, but the effect is the same: nurse practitioners (NPs) count.

Where a note can legally be requested, it cannot be rejected just because an NP signed it instead of a physician.

Issuing a doctor's note touches two separate areas of law: employment standards and privacy. Neither has a single national rule, so what applies depends on the patient's province and their employer.

Employment Standards

There's no single national standard for sick notes. Requirements come from provincial employment standards legislation.

For instance, Ontario's Employment Standards Act, British Columbia's Employment Standards Act, and similar legislation in other provinces each set their own rules for when an employer can ask for a note and what it needs to contain.

Meanwhile, federally regulated employees (banking, airlines, telecommunications, interprovincial transport) fall under the Canada Labour Code instead.

Privacy Legislation

Healthcare providers must follow Canadian privacy legislation, including PIPEDA and applicable provincial health privacy acts, disclosing only what's necessary with the patient's consent.

Depending on the province, additional legislation, such as the following, govern how patient information is collected, used, and shared:

2. Include Basic Patient Information

Start the note with essential patient details such as their full name, date of birth, and the date of the note’s issuance. This ensures that the document is personalized and correctly linked to the patient in question.

3. State the Note’s Purpose

In clear and simple terms, explain why the note is being issued. Reasons might include verifying an illness, recommending rest and time off, or clearing a patient for work, school, or other activities.

This is to confirm that Ms. Mary Beth Gaskill was assessed at our clinic on January 14, 2026. Due to medical reasons, she is unfit for work from January 15, 2026, to January 16, 2026, inclusive. She is expected to be able to return to full duties on January 17, 2026.

4. Conclude with a Signature and Official Stamp (if applicable)
